OFFICIAL RULES
NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN, NOR WILL A PURCHASE IMPROVE ONE'S CHANCES OF WINNING
1. SPONSOR: Disney Worldwide Services, Inc., 500 South Buena Vista St., Burbank, CA 91521, is solely responsible for all aspects of this sweepstakes ("Sweepstakes").
2. ADMINISTRATOR: Pacesetters Media, LLC, dba MobileCause, 13821 Newport Ave., Suite 105, Tustin, CA 92780, an independent judging organization whose decisions are final and binding as to all aspects of the Sweepstakes.
3. ENTRY: You may enter this Sweepstakes, during the period commencing December 3, and ending December 17, 2007 ("Entry Period"), by sending on your cell phone ("Cell") the keyword, "Heart" to the SMS shortcode 27138 ("Entry"). All standard carrier-messaging charges will apply and you will receive on the Cell a confirmation SMS message that states: "Thanks for showing your heart of gold to support Toys4Tots. Listen for your call from Cinderella tomorrow between 9a-12p PST from (888) 896-9582." For purposes of these Official Rules ("Rules"), all times and days are Pacific Standard Time.
4. LIMITATIONS: All Entries must be received by 11:59:59 P.M., December 17, 2007. Only one Entry per person/Cell (regardless of whether one person has more than one cell phone or more than one person use the same cell phone). In event of a dispute regarding the identity of the person submitting an Entry, the Entry will be deemed to be submitted by the person in whose name the Cell is registered. Entries by any method other than set forth above in Section 3 are void. Any use of automated or programmed methods of effecting Entry is prohibited. Open only to persons who are legal residents of, and physically located within, the 50 states or D.C. (collectively, "Territory") and not employees of Sponsor or Administrator; their respective parent, subsidiary or affiliated companies; or the advertising, promotional or fulfillment agencies of any of them (individually and collectively, "Entities"); nor members of their households or immediate families. Neither the Entities, nor any of their officers, directors, shareholders, employees, agents or representatives (individually and collectively, "Releasees") are responsible for Entries from persons residing, or physically located, outside the Territory; Entries that are altered, delayed, deleted, destroyed, forged, fraudulent, improperly accessed, inaccurate, incomplete, interrupted, irregular in any way, late, lost, misdirected, multiple, non-delivered, stolen, tampered with, unauthorized, unintelligible or otherwise not in compliance with these Rules; or for lost, interrupted or unavailable network, server or other connections; miscommunications; failed phone, computer hardware or software or telephone transmissions; technical failures; unauthorized human intervention; traffic congestion; garbled or jumbled transmissions; or other errors of any kind, whether due to electronic, mechanical or human error or other causes; even if caused by the negligence of any of the Releasees. Each of such potential Entries will be disqualified. Void where prohibited or restricted by law and subject to all applicable federal, state, local and municipal laws and regulations.
5. PRIZE: One (1) GRAND PRIZE: prize consists of a donation of $10,000 by the Sponsor to a Sponsor-selected Toys For Tots Chapter and one (1) of each of the following elements: [1] Princess LCD TV (approximate retail value ("ARV"): $200); [2] Enchanted Tales Throne (ARV: $50); [3] WII videogame (ARV: $40; [4] 4 pieces of canvas art (ARV: $40); [5] twin comforter (ARV: $30); [6] Aurora doll (ARV: $20); [7] Color Wonder Sprayer (ARV: $20); [8] set of twin sheets (ARV: $19); [9] hot cocoa set (ARV: $15) and [10] pop up book (ARV: $13). Value of donation: $10,000 and the ARV of all prize elements: $447. Prize is not redeemable for cash or transferable. No substitution allowed except, at Sponsor's sole discretion, a prize of equal or greater value may be substituted. The prize will be awarded provided it is validly claimed by January 15, 2008, after which no alternate winner will be selected, nor unclaimed prize awarded.
6. PROCEDURES: Entries will only be accepted during the Entry Period. On or about December 19, 2007, in a random drawing, the potential winner will be selected from all eligible Entries received. Odds of winning depend on the total number of eligible Entries received.
7. WINNER: Potential winner will be notified at the Cell on or about December 20, 2007. All legal responsibilities of a minor under the Rules will be assumed by the parent/legal guardian. At the sole discretion of the Sponsor, disqualification, forfeiture and the selection of an alternate winner may result from any of the following: [1] potential winner's failure to respond to notification within five (5) days after its transmission; [2] the return of any other notice or the prize as undeliverable; [3] potential winner's failure to provide Administrator with satisfactory proof that he/she is the authorized account holder of the Cell associated with the winning Entry; [4] potential winner's failure to execute and return an Affidavit of Eligibility/Liability/Publicity Release within ten (10) days after its mailing; [5] potential winner's failure to claim the prize within ten (10) days after it is sent; [6] potential winner's failure to validly claim the prize by January 15, 2008 and [7] any other non-compliance with Rules. In the event of any prize forfeiture, the Sponsor may, in its sole discretion, award, or not award, the prize to an alternate winner. All taxes are solely the responsibility of the winner. For the name of winner (after December 20, 2007) and/or Rules (before December 17, 2007), send a self-addressed, stamped envelope to: Disney Princess Have a Heart of Gold Sweepstakes, 500 South Buena Vista St., Burbank, CA 91521-6444.
8. CONDITIONS: Each entrant by entering this Sweepstakes agrees that: [1] he/she will be bound by the Rules and the Sponsor's decisions; [2] the Entry becomes solely the Sponsor's property; [3] he/she releases and holds harmless the Releasees from any and all liability for claims, injuries, losses or damages of any kind, including without limitation, death and bodily injury, resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of any prize or participation in any Sweepstakes-related activity or travel; [4] the prize is awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose); [5] winner's acceptance of the prize constitutes the grant of an unconditional right to Sponsor and assigns to use winner's name, address (city and state only), voice, likeness, photograph, biographical and prize information and/or statements about the promotion for any publicity, advertising and promotional purposes without additional compensation, except where prohibited by law; [6] in the event viruses, bugs, unauthorized human intervention, Acts of God, acts or regulations of any governmental or supra-national authority, war, national emergency, accident, fire, riot, strikes, lock-outs, industrial disputes, acts of terrorism or other matters beyond the Sponsor's reasonable control, corrupt, prevent or impair the administration, security, fairness or proper play of this Sweepstakes, so that it cannot be conducted as originally planned, except where prohibited by law, the Sponsor has the right, in its sole discretion, to modify the Rules or to cancel, modify, terminate or suspend the Sweepstakes; and in such event, to select winners by such method as Sponsor in its sole discretion shall consider equitable; [7] the Releasees are not responsible for typographical or other errors in the offer or administration of this Sweepstakes, including but not limited to: errors in the advertising, Rules and selection and announcement of the winner; [8] any portion of the prize not accepted or used by the winner will be forfeited and [9] the Releasees are not responsible for any inability of the winner to accept or use the prize (or any portion thereof) for any reason.
